1. Nature of the relationship

GIFTA facilitates the gifting of products to creators on a non-paid, non-advertising basis. Acceptance of a gifted product is not intended to create an advertising, employment, agency, or commercial relationship between the creator, GIFTA, or the brand.

2. No contractual requirement or obligation

Creators are not contractually required to create, publish, or share content. There is no obligation or expectation to post, and choosing not to post has no impact on participation in current or future gifting opportunities.

3. Editorial independence

Any content a creator may choose to share is voluntary and created under the creator’s own editorial control. GIFTA and brands do not require or approve content in any way.

4. No advertising placement

Gifting is not provided on the basis that content must be created and does not involve paid placement. There is no arrangement requiring a creator to publish advertising material on their social media channels.5. Product information

Any information provided with a gifted product is factual and for reference only. It does not constitute a content brief and does not require inclusion in any content.

6. Feedback

Creators may choose to share feedback privately, but this is optional and not required.

7. Disclosure and transparency

If a creator voluntarily chooses to post, they are encouraged to be transparent with their audience (e.g. “Gifted” or “PR product”).

8. HFSS and regulated products

Some gifted products may fall within categories subject to additional advertising restrictions under the CAP Code, including HFSS rules. GIFTA does not secure paid advertising placement for such products, and any content shared by creator ss voluntary and independent.

9. Use of Content

Where a creator independently chooses to publish content featuring a gifted product, the creator grants permission for GIFTA and/or the relevant brand to use that content, with appropriate credit.

Any such use is not a condition of gifting, and does not affect participation in current or future gifting opportunities.

10. Independence of opinion

Where a creator independently chooses to publish content, they are free to express their honest views, whether positive, neutral, or negative.

GIFTA and participating brands do not require favourable coverage, do not restrict opinion, and do not request changes to a creator’s views or tone.
